FINANCIAL ACTION ITEMS
A. It is recommended that the Board of Education accept a donation for East Hill Elementary School from the Travelers Employee Giving Campaign in the amount of $49.50, and it is further recommended that the 2017-18 general fund budget be amended as follows to reflect said donation:

A960 -Appropriations A2110-501-05-0000 – General Supplies – EH $49.50

B. It is recommended that the Board of Education accept a donation of $215.00 from the East Hill Elementary PTA for supplies, and it is further recommended that the 2017-18 general fund budget be amended as follows to reflect said donation:

C. It is recommended that the 2017-18 general fund budget transfers be approved, as stipulated.

D. It is recommended that the Board of Education authorize an increase in the 2017-18 general fund budget for unemployment insurance expenditures in the amount of $625.25 for the period of October 1, 2017, through December 31, 2017, to be funded by a transfer from the Unemployment Reserve Fund.

E.  It is recommended that the health services contracts between the West Genesee Central School District and the schools listed below, for health service provided by this district to non-residents attending non-public schools in our district during the 2017-18 school year, be approved:

F. It is recommended that the following resolution be approved:
RESOLUTION OF THE BOARD OF EDUCATION APPROVING THIRD AMENDED AND RESTATED COOPERATIVE HEALTH AGREEMENT

WHEREAS, the West Genesee Central School District is a participating member of the Cooperative Health Insurance Fund of Central New York (the “Cooperative”) formed pursuant to Article 5-G, Sections 92-a and 119-o of the New York State General Municipal Law for the purpose of jointly procuring health insurance to provide basic hospital, surgical, medical, and prescription drug benefits to their eligible employees and retirees; and

WHEREAS, the Cooperative is currently governed by the terms of a “Second Amended and Restated Cooperative Health Agreement” (the “Current Operating Agreement”) but has been presented with an amended governance agreement titled the “Third Amended and Restated Cooperative Health Agreement” (the “Proposed Operating Agreement”); and

WHEREAS, the Cooperative Board of Directors has voted in favor of adoption of the Proposed Operating Agreement for purpose of governance of the Cooperative effective September 1, 2018; therefore

BE IT RESOLVED, that the Board of Education of the West Genesee Central School District hereby approves the terms of Third Amended and Restated Cooperative Health Agreement as the sole governance agreement of the Cooperative, replacing and superseding the Current Operating Agreement in its entirety, and agrees that its continuing participation in the Cooperative will be bound by its terms.

This resolution shall take effect immediately and shall be delivered to the Chairperson of the Cooperative.

G. It is recommended that the property tax exemptions for members of volunteer fire departments and ambulance services be approved for the 2018-19 school year, as stipulated.

H. It is recommended that the following property tax exemptions, for the qualifying individuals of the West Genesee Central School District be approved for the 2018-19 school year, as stipulated.
Persons with Disabilities whose incomes are limited by such reason of such disability, pursuant to Section 459-c of the Real Property Tax Law. Over Age 65, pursuant to Section 467 of the Real Property Tax Law.

I. It is recommended that the Alternative Veterans’ Exemption from real property taxation for the qualifying individuals of the West Genesee Central School District be approved for the 2018-19 school year, as stipulated.

J. It is recommended that the following resolution be approved:

WHEREAS, Real Property Tax Law §487 provides that solar or wind energy systems or farm waste energy systems are exempt from real property taxation for a period of fifteen years; and

WHEREAS, the School District Board of Education previously adopted a resolution providing that the exemption under Real Property Tax Law §487 shall not apply within its jurisdiction; and

WHEREAS, Governor Cuomo signed into law Chapter 336 amending Real Property Tax Law §487; and

WHEREAS, effective January 1, 2018, Real Property Tax Law §487 will further provide that certain micro-hydroelectric energy systems, fuel cell electric generating systems, micro-combined heat and power generating equipment systems and electric energy storage equipment and electric energy storage systems will be exempt from real property taxation for a period of fifteen years; and

WHEREAS, Real Property Tax Law §487 permits a school district to adopt a resolution providing that the exemption under Real Property Tax Law §487 shall not apply within its jurisdiction to such energy system projects which begin construction subsequent to the effective date of such resolution; and

WHEREAS, the Board of Education desires to adopt a resolution opting out of the tax exemption under the amended Real Property Tax Law §487.

NOW, THEREFORE, BE IT RESOLVED that:
1. The Board of Education reaffirms its prior resolution that the tax exemption under the Real Property Tax Law §487 shall not be applicable within the boundaries of the West Genesee Central School District with respect to any solar or wind energy systems or farm waste energy systems.

2. The tax exemption made available by Real Property Tax Law §487 shall not be applicable within the boundaries of the West Genesee Central School District with respect to any micro-hydroelectric energy systems, fuel cell electric generating systems, micro-combined heat and power generating equipment systems and electric energy storage equipment and electric energy storage systems constructed subsequent to the date of this Resolution.

3. This Resolution shall take effect immediately.

K. It is recommended that the stipulated equipment and materials be declared surplus and disposed of in accordance with New York State law.

L. It is recommended that the following resolution be approved:

WHEREAS, the West Genesee Central School District (the “District”) Board of Education has considered the impacts to the environment of the following Scope of Work to be completed:

Exterior door replacements with secure entry ways, secure window replacements, interior classroom door hardening and security technologies.

WHEREAS, the Board has reviewed the scope of the project and has further received and considered the advice of its Architects with respect to the potential for environmental
impacts resulting from the proposed action; and

WHEREAS, the Board has reviewed the Proposed Action with respect to the Type II criteria set forth in 6 NYCRR part 617.5(c), now therefore;

BE IT RESOLVED, by the Board of Education as follows:

  1. The Proposed Action does not exceed thresholds established under 6 NYCRR
    Part 617, State Environmental Quality Review Act, (SEQRA).
  2. The Board hereby determines the Proposed Action as a Type II action in
    accordance with the SEQRA regulations.
  3. No further review of the Proposed Action is required under SEQRA.
  4. This resolution shall be effective immediately.
